A hung jury cannot be replaced by alternates. Once the jury begins deliberating, the jurors are locked in unless there is a serious emergency of some kind that renders a juror unable to continue. Jurors cannot be replaced simply because they are hold outs from the majority of the juror's opinion.
 
They did exactly that in another high profile case not too long ago. One juror refused to negotiate at all when they got the case so that juror was replaced at the request of the rest of the jury.

I can't even remember her name, but it was the case about that blond that died in the Caribbean.
 
The mother is innocent of the charge of murder, proven in a court of law.
The police now have to continue looking for the killer.

Do the police refuse to investigate a murder because the principle suspect has been declared not guilty?
Can they continue investigating the mother or is that harassment?

That is an exception. In that case, the judge had to rule that juror was unfit to serve - and he darn well had to be able to substantiate it so that an appellate court would agree with his decision.

She can not be tried for the murder again.

Tony is spot on. Even if she holds a press conference and publicly confesses, she cannot be tried again on any of the charges of which she was found innocent. She could be tried in Federal court on Federal charges; but that is not likely to happen.
 
So what do the police now do, forget about it and walk away, or on the slim chance the jury was correct keep looking for another suspect? The thing is a lose lose for all.

"It all came down to the evidence," said Florida state attorney Jeff Ashton on "The View." "I think ultimately it all came down to -- at least from what the one alternate said -- it came down to the cause of death.
 
Question, if the jury had not come to a decision on this it would have been a mistrial. So now would that mean that the case against her was then also dropped as in a not guilty verdict.

I was just thinking about the different parties involved here.

The jury - How are these ordinary people that did not volunteer for this going to have to live with the outcome of this verdict.

The defence - How do these people feel knowing that a person is guilty as sin and they got them off.

The prosecution - How do they live with it knowing that because they did not do their jobs that a person like this is now free.

The mother - Well I suppose they will get her when she murders her next child :y8:

A mistrial usually means a retrial, a new trial. That decision is up to the prosecution. They can decide to request another trial or they can decode to drop the charges.

It will not bother the defense that they got a guilty person off. That is their job under the Constitution. The defense attorney with the beard flipped off reporters when leaving the court house.

You are spot on. She also has been offered a very lucrative contract for porn movies.
 
Well then if they were so torn over giving a not guilty verdict why did one of them just not hold out and have a mistrial and they could have had another go at it

I can't speak for the jury but they did take an oath when they appeared for jury selection and more than likely again when they were seated. For that reason they probably were unwilling to compromise that oath by not voting opposite of the evidence presented to them.

The Constitution was written, when it comes to trials with one thought in mind, it is better for a the guilty to go free rather than the innocent to be convicted in criminal cases. The standard is "Guilty beyond reasonable doubt." in civil cases the burden of proof is much less, "Guilty on the balance of probabilities" which means one side only has to tilt the scale in their favor to win. Unfortunately all the prosecution did in this trial was tip the scale. How that will help the jury deal with their decision, I have no idea other than they followed their instructions and therefor did the right thing.

Before anyone bites my head off, I believe she is probably guilty from what I've read and heard. However this information has all come from the media and I'm not one that believes everything the media reports.
