Suppose he'll get a slap on the wrist and told to be a good boy from now on, well that's how it usually goes. ANGER

But the bloke who lost a leg has to live with it for the rest of his life. Some will even say its "his" fault for riding a bike and not being in a cage. THe world seems to reward the idiots.
 
I am always sorry to hear of a rider being injured, especially when he is not at fault. I suspect that he has no insurance either. I hope he gets the max for DUI. It is probably his first offense in Florida; but I'll bet it is not his first DUI.
 
Pisses me off no end too.

I hope the guy comes out okay, moreso adjusting to a new way of life.

That driver CHOSE to get behind the wheel. In my eyes its the same as planning a murder.

Not trying to divert this thread but hopefully adding to it.
Another example of the frustration we suffer from courts not protecting us and letting criminals out on bail.

Extract from The Sydney Morning Herald.

"Mr Karwaj, the 27-year-old dedicated Rural Fire Service volunteer was driving to work early that morning when a learner driver allegedly careered through a give way sign at an intersection on Richmond Road in Marsden Park. It was the third fatal crash on that stretch of road in four months.
On Friday, exactly one month after the tragic incident, police said that the 24 year-old man was not only an unaccompanied learner driver but he was also driving a stolen car and under the influence of alcohol.
Seven charges have been laid including dangerous driving occasioning death.
The Lithgow man suffered some head injuries but is now walking again, and on bail until a court appearance next month.
Mr Karwaj's family, however, have lost their son and brother forever.

Why is this prick (unlicensed driver, car thief and a drunk) on bail ???
 
I share your anger and frustration. We have the same problem in the US. In the US bail is is allowed due to the presumption of innocence, a person in innocent until proven guilty in a court of law. There is no bail for for a first degree murder charge. Considerations in setting bail or denying bail, which can be done, are flight risk and danger to society, as well as other factors. To me in scenario you described, the person has demonstrated he is a danger to society and therefore, IMHO, bail should be denied. But, alas, it does not seem to work that way.
 
Here is a follow up on the situation....with a bit of a rant from the injured riders friend. But by no means un called for.
What a screwed up system.
He is recovering from injuries. He did lose his leg though. The drunk that hit him is still in jail and still claims it wasn't his fault. State trooper told me today that it is his SEVENTH DUI. Go Alabama!! Personally I believe that someone that gets more than three DUI's in ten years should get prison term and not be allowed to reach the seven number. I'm not sure if any of the first six resulted in injury . The state trooper said that he made the claim that "Them damn bikers should watch where they are going". It was stated by witness's that the Van just pulled right in to the motorcycle with no time to react. Pretty sad when it happens to someone that is just out for a nice afternoon ride. He wasn't speeding or drinking but is paying the price for loving his motorcycle.Some say that is why they are called accidents but when you drive after six dui's then it is premeditated murder to me.
Sorry for the rant Phillip is just a nice hard working man that enjoyed the occasional motorcycle ride!!!

This really does suck and I agree with so many DUI against him anyone can work it out that it is only a matter of time before he kills an innocent person. Now that it is really too late having caused life changing injury you wonder what they will do about it.
 
In Pennsylvania he'd have done jail time on his 2nd DUI. And now driving on a suspended licence and being involvrd in an accident that injured someone....he'd looking at years in jail.

The problem is those seven DUI's were in Alabama as far as I know. I don't know if Florida can use those DUI's when considering the punishment other than give him the max for one DUI. They can sentence him on each of the counts and have the sentencing run consecutively.

same here 2nd time jail 18months 3rd time 5years ! and that is without an accident . add anjury to them and you are not getting out for a long time.
 
Some of the Texas District Attorneys are starting to file murder charges for DUI cases that resulted in a death. For injuries the number filing harsher charges aren't as many as the murder cases but it is increasing. The State hasn't worked out all the details yet but hopefully with the legislature being in session this year they will get something done to make it the same across the State.
 
In Pennsylvania if you cause a death while DUI it's vehicular homicide regardless of if it's your passenger or someone outside your car or any motor vehicle.

You can even get a DUI riding a horse or driving a carriage or buggy.
