On 14 June my car, thank God not my motorcycle, was rear ended by a person insured by USAA. I had stopped for pedestrians who were about to cross the street. I was hit so hard that I was pushed throught the intersection and several feet beyond. If I had been on my motorcycle I would probably not be writing this or anything in the future. The police department determined that person was at fault. USAA is still investigating whether they are liable or not. They are doing this to save money by not providing me with a car while mine is being repaired. My insurance company, Mutual of Enumclaw, is getting the repairs underway while USAA drags their feet and will have to seek re-payment from USAA. If you have insurance throught this company, you may want to reconsider.

I would think that your own insurance company would provide you with a loaner car to use and then collect that from USAA when it's all settled.

At least here in Pennsylvania, there is no circumstances when the person that rear-ends you can't be at fault. It is an automatic thing since you are supposed to keep your own vehicle under control and able to stop not matter what the reason is that the person in front of you came to a stop.

You are so right about the fault, but since I do not have coverage for a loaner car, I would have to finance it until they quit dragging their feet. I did send a complaint to the Washington State Insurance Commission.

Well Dave I am glad you are ok, even here if you get hit from the rear your are not at fault. However we claim from our insurance they provide the loan car and then when all is done they are supposed to claim it back from the other insurance

Dave, I am sure glad you did not get hurt. And I'm sorry about the hassle from USAA. This is not the first time I have heard this complaint. Insurance laws vary state by state. By any chance was the other driver on a cell phone or texting?

I guess they are okay if it's your car that is damaged. The car that hit me is in the shop being repaired. My insurance is now handling mine until they get off of their duff. What's funny is when the tow truch hooked up to mine, I told him it was an all-wheel drive and he told me that because it had a manual transmission he did not have to dolly the rear just the front. He got about a half a block away and the all-wheel kicked in and he smoked my tires and god knows if he damaged my transmission. I called the repair shop and told them what happened and ask to check out the transmission and tires. The shop guy told me was calling the owner of the tow company and let him know he may be on the hook for some more repairs. Why is everone picken on me!!!!

The tow truck driver is a complete MORON. That car should have been flat-bedded.

If you MUST tow it with wheels on the ground, then you must disconnect the driveshaft.

Exactly!! What an idiot. I would not have let him hooked to my vehicle.
